Subscription Terms of Service

The following terms and conditions constitute a legally binding contract (the “Agreement”) that governs the Myfinancesheet Subscription Services (“Subscription Services”) provided by Myfinancesheet.com. (“Myfinancesheet”, “we”, “our”) to you (“you” or “yours”).

The Subscription Services are offered subject to your acceptance without modification of all the terms and conditions contained herein. We also have other policies and procedures including, without limitation, Terms of Service, Privacy Policy, Refund Policy, and others. Those policies contain additional terms and conditions, which apply to the Subscription Services and are integral part of this Agreement. YOUR USE OF THE SUBSCRIPTION SERVICES CONSTITUTES YOUR ACCEPTANCE OF AND AGREEMENT TO BE BOUND BY THIS AGREEMENT AND OUR TERMS OF SERVICE. If you do not agree to this Agreement, do not use the Subscription Services and/or our website Myfinancesheet.com (the “Site”).

1. Product Terms

1.1. Excel Templates Plan. Myfinancesheet.com offers several Excel templates like Swing Trading Journal (equity), Intraday Trading Journal (equity), Intraday Trading Journal (Derivative) and many more. You can check your subscription status of the purchased product by clicking on the “Your Account” link. We reserve the right to modify, terminate or otherwise amend our offered Excel templates at any time.
1.2 Provision of Products. Each Product is provided on a periodic subscription basis. Each Subscription product will terminate on the date of expiration. We’ll notify you through e-mail 30 days before the end of the subscription. Myfinancesheet grants you a nonexclusive, non-transferable license to use the Product You Purchase.

2. Responsibilities

2.1 Myfinancesheet’s Responsibilities. Myfinancesheet will ensure that live share price will be available to customer journals with a 99% Uptime. And customer data will remain safe while activating the product. We’ll make sure to grant you subscription access to your product within 3 days of the customer data verification period. Scheduled maintenance, which will occur on weekends and for no more than 2 hours per month. If customer face any difficulty they can freely contact to us by [email protected] within business days.
2.2 Your Responsibilities. You will (a) be responsible for Your Users’ compliance with this Agreement, and will be responsible for Your Data, which is any information of any type which You provide in connection with using the Product, including without limitation information which You input or provide Myfinancesheet for inputting, into the Product. You will also be responsible for a) the means by which You acquired Your Data, (b) using commercially reasonable efforts to prevent unauthorized access to or use of Product, c) notifying Us promptly of any such unauthorized access or use, and (d) using Product only in accordance with this Agreement and applicable laws and government regulations.

3. Ownership.

3.1 Myfinancesheet. This is a subscription agreement for use of Myfinancesheet’s Product and not an agreement for sale. You acknowledge that You are obtaining only a limited right to the Product and that irrespective of any use of the words “purchase”, “sale” or like terms hereunder no ownership rights are being conveyed to You under this Agreement. You agree that Myfinancesheet retains all rights, titles and interests (including all patent, copyright, trade secret and other intellectual property rights) in and to the Product, and any and all underlying Excel templates. Further, You acknowledge that the Myfinancesheet’s Product that you have no right to obtain a copy of the Product itself.

4. Use Rights.

4.1. License. The Excel template is licensed, not sold. Under this agreement, we grant you the right to run one instance on your device (the licensed device), for use by one person at a time, but only if you comply with all the terms of this agreement. We regularly monitor all of clients’ Excel templates that are operating on clients’ devices and track how many times a single user opens a single product. If we found any strange behaviours using any product key of any user across multiple devices, we reserve the right to terminate the Excel Template of that user.

4.2. Device. Before we upload any product, we thoroughly tested our Excel templates on many devices of different Windows OS and different Ms office versions. When purchasing any product from Myfinancesheet, the customer must select the supported OS and MS Office version, if installed on their device.
4.3. Restrictions. Myfinancesheet reserves all rights (such as rights under intellectual property laws) not expressly granted in this agreement. For example, this license does not give you any right to, and you may not:
(i) publish, copy, rent, lease, or lend the Excel Template;
(ii) transfer the Excel Template;
(iii) work around any technical restrictions or limitations in the Excel Template;
(iv) reverse engineer, decompile, crack or disassemble the Excel Template;
d. Backup copy. You may order or download a backup copy of the Excel Template from your account.

5. Activation.

5.1. Activation. After purchasing a digital product, the customer can activate it by watching the activation instructions video that is included in the download zip file. While activating your product user needs to connect the device to the internet. During the activation process when the user clicks on the ‘Send Details’ button the excel template automatically sends all required licence and device hardware details from the client’s device to our server. The client can temporarily activate the product for 3 days, within 3 days the client will receive an activation key through email. We will verify the client information before giving subscription access to the product on our server. Within 3 days, the customer will notify to reactivate that product. If the product is fully accessible, the user will have lifetime access to the contents for as long as the product(s) are available. And if the product is subscription-based, the customer will obtain access to that product depending on the subscription period.

6. Updates.

6.1. Updates. We’ll automatically send you a new updated Excel template to the registered clients to their email along with an update and data backup procedure. The client needs to follow the update procedure to update to the new version of the Excel template.

7. Billing.

7.1. Recurring Billing. By starting your Myfinancesheet subscription service, you authorize us to charge you a periodic subscription fee before the end of the subscription.
7.2. Price Changes. We reserve the right to adjust pricing for our service or any components thereof in any manner and at any time as we may determine in our sole discretion. Except as otherwise expressly provided for in this agreement, any price changes to your service will take effect following email notice to you.
7.3. Billing Cycle. The Excel Template subscription fee will be billed at the beginning of your Subscription Period thereafter unless and until you cancel your Excel subscription plan). We reserve the right to change the timing of our billing, in particular, if your payment has not been successfully settled.
7.4. Cancellation. You may cancel your Myfinancesheet Excel Template subscription plan with 30 days’ notice by emailing [email protected]. Cancellation is immediate upon Myfinancesheet’s receipt of your request.
7.5. Partial Billing. Myfinancesheet may not provide partial billing, user have to pay the total amount of the product and subscription plan. At any time, and for any reason, we may provide a refund, discount, or other consideration to some or all of our members (“credits”). You are responsible for paying Myfinancesheet up through the end of the period for which Myfinancesheet has provided its product and/or services.

8. Term and Termination.

8.1. Term. This Agreement is effective as of the Effective Date and expires on the date of expiration or termination of any Subscription Term.
8.2. Termination for Cause. Either party may terminate this Agreement (including all related Order Forms) if the other party fails to cure any material breach of this Agreement (including a failure to pay fees) within 30 days after email notice.
8.3. Effect of Termination. Upon termination of this Agreement, your Product will be set to the Restrict zone, and your license to your previous Subscription plan will be terminated. You agree to destroy all copies of the Excel Template in your possession. Upon termination for any reason, you will have full access to your data for at least a two-week period. Upon your request, Myfinancesheet will delete all data collected through your application from all servers within two weeks of receiving notice.

9. Limitation of Remedies and Damages.

9.1. Limitation of Remedies. Notwithstanding the Confidentiality provisions below, neither You nor Myfinancesheet shall be liable for any loss of use, lost or inaccurate data, failure of security mechanisms, interruption of business, costs of delay or any indirect, special, incidental, reliance, or consequential damages of any kind, including lost profits, regardless of the form of action, whether in contract, tort, strict liability or otherwise, even if informed of such damages in advance.
9.2. Entire Liability. Notwithstanding any other provision of this agreement, Myfinancesheets and Your entire liability shall not exceed the amount actually paid to Myfinancesheet during the duration of the Subscription Term.

10. Technical Support Service.

The Technical support Service Provider will provide the Customer access to telephone and email assistance from Monday to Friday within business hours. The support will be provided in either English or Hindi.
